Imagine you’re at school, and there’s a teacher who always picks on you, blames you for things you didn’t do, and makes you feel terrible in front of your classmates. You might think, “This is so unfair! I want to tell someone and make it stop!” Well, grown-ups at work can feel the same way when their boss or coworkers mistreat them. But, like in school, not every mean thing a teacher or classmate does is against the rules. Sometimes, it must be really bad for the grown-ups to get help from the law.

The Story of a Tough Workplace

In a recent case, a woman said her boss made her work life miserable. She said he picked on her, blamed her for things that weren’t her fault and talked to her in a mean way. He even gave her a letter saying she wasn’t doing a good job and put her on a special plan to improve her work, which she thought was just a way to get rid of her.

Why This Is Not a Hostile Work Environment

There are several things that someone must prove to demonstrate that a workplace is hostile. One of them is that they experienced bad behavior that was so bad that it changed their job and made it a terrible place to work.

In this case, the judges heard her story and thought, “Hmm, this doesn’t seem bad enough.” The judges compared it to another case where a woman had a terrible rumor spread about her, which made everyone at work treat her badly, even threatening her. That was really bad.

What We Can Learn.

For people who work in human resources (the people who help with problems at work) and lawyers (the people who help with legal problems), this case teaches an important lesson: Not every bad or unfair thing at work is against the law. The bad behavior has to be really, really bad to count as a hostile work environment.

So, like in school, where not every mean thing a teacher or classmate does is against the rules, the same goes for grown-ups at work. The law is there to help when things get really bad, but it has to be more than just a tough or unfair boss.
