I’m a little late to the employment law blogger party where we fearmonger about Coronavirus and what employers should do about employee travel.
I planned to take a pass on that.

According to a recent survey, 17.5 million American workers may be skipping work today, the day after the Super Bowl. About 6 in 10 of those employees had their Monday absence pre-approved. So, at least you can plan for that.
But, what about the other 6-or-so million?

The U.S. Department of Labor could have rested on its overtime-rule laurels in 2020. Instead, the DOL has wasted little time releasing three new opinion letters in 2020. I’ll break them down for you below.

Regular, in-person attendance is generally critical to performing one’s job. So, when an employee exhausts her twelve weeks of leave under the Family and Medical Leave Act only to miss another 33 days of work (resulting in a 59% absentee rate), one’s job security may be in jeopardy.
