Survey shows that the new proposed #overtime rules may be like whoa!

You know those proposed overtime rules from the Department of Labor. The ones where the salary-level for the white collar exemption will jump from $23,660 per year to over $50,ooo in 2016. Well, check this out.

A survey on CareerBuilder.com of more than 1,000 “9-5 workers” shows that 50 percent of these workers say they check or respond to work emails outside of work, and almost 40 percent of them say they continue to work outside of office hours.

Let’s assume that these folks currently satisfy the white-collar exemption requirements. No overtime. But, if they make less than $50k, then under the new proposed rules, it’s either give them a raise, classify them as independent contractors, or pay them overtime when they inevitably work more than 40 hours in a workweek. As Jon Hyman at the Ohio Employer’s Law Blog pointed out in a post today, you need to pay employees if you know, or should know, they are working overtime.
