The Department of Labor Wage and Hour Division (WHD) previously announced that it is reviewing the minimum wage and overtime rules — specifically, as they relate to exemptions that employers take for bona fide executive, administrative, and professional (EAP) employees under the Fair Labor Standards Act.
In prior rulemakings, WHD committed to updating the standard salary level for these EAP employees to satisfy the exemption. In 2020, the WHD raised the minimum salary level from $455 to $684 per week. It stayed that way in 2021 and into 2022.
But the WHD is pushing regular updates to “promote greater stability” and “avoid disruptive salary level increases that can result from lengthy gaps between updates and provide appropriate wage protection.”
Beyond the appropriate EAP salary level, the WHD is homing in on related issues, such as:
- the costs and benefits of increasing the salary level to employers and employees, including increasing wages and reducing litigation costs;
- the best methodology for updating the salary level, and the appropriate frequency of updates;
- whether other changes to the overtime regulations are warranted.
