I didn’t … until I read this WSJ.com article from Anne Tergesen on Saturday.
Under the new American Rescue Plan, long-story-short, starting April 1, COBRA-eligible individuals can get COBRA continuation coverage for themselves and their families through September 30, 2021. Check it out for yourself. And here and is a SHRM summary of the new COBRA changes.
At a minimum, you’re going to need some new COBRA forms.
However, ***checks notes*** it says here that I am an employment lawyer and not an employee benefits lawyer. So, I’m not going to try to explain to you any more ins and outs of these new COBRA changes. That’s what Google your outside counsel is for. Personally, I’ll give a holler to one of my fantastic employee benefits partners when my clients call me.
Still, I’m not completely useless. And I’ll prove it this Friday, 3/19, at Noon ET when David Miklas, one of my favorite management-side employment lawyers on LinkedIn, joins me to discuss FFCRA leave under the American Rescue Plan and OSHA’s new national emphasis program to protect high-risk workers from COVID-19 hazards.
And if you have hypothetical questions that you want to ask for a friend and that won’t create any attorney-client privilege between us, David and I will do our best to answer them without saying it depends. But, hurry! You can email them to me, but others are already first in the queue. We’ll answer as many as we can.
